Terms of Service

Nothing in these terms excludes, restricts or replaces consumer guarantees, privacy rights, statutory remedies, or other rights that cannot lawfully be waived in your jurisdiction. This applies throughout these terms, including the license restrictions, warranty disclaimer and liability provisions.

1. Acceptance of Terms

These terms describe use of the Notchy application ("the App") and the notchy.dev website ("the Website"). Review them before downloading, installing or buying a license for the App. Where applicable law requires express acceptance, merely browsing the Website does not substitute for that acceptance.

2. License Grant

When you buy a license, or receive a supporter license (section 7), Notchy grants you a personal, non-exclusive, non-transferable, perpetual license to use the App for personal or commercial purposes on one Mac that you own or control, in accordance with these Terms. Updates to the App are included at no extra cost. During the free trial (section 3), the same license applies for the length of the trial.

3. Free Trial

The App includes a 7-day free trial with every feature and no payment details required. The trial starts the first time you open a paid release of the App on a Mac. When it ends, the App asks for a license key and stops working until a license is activated. One trial is available per Mac.

4. Purchase and Payment

Licenses are sold by Dodo Payments, which acts as our authorized reseller and Merchant of Record: it processes the payment, collects any applicable sales tax or VAT, and issues your receipt. Your purchase is also governed by the Dodo Payments Buyer Terms. The price is a one-time $24.99 in the United States, €24.99 in the euro area and £24.99 in the United Kingdom, before tax; elsewhere, checkout converts the price to your local currency. Any sales tax, VAT or GST that applies where you live is added at checkout. Checkout shows the final amount and currency before you pay. There is no subscription and no automatic renewal.

Your license key is shown after checkout and emailed to the address you used. The App activates it online on one Mac. To confirm the license is still valid, the App checks it with the license server a few times a day while it runs; it keeps working without a connection for up to 30 days, after which it asks to connect once to confirm the license.

5. One Mac, and Moving to a New Mac

A license activates the App on one Mac at a time. Each additional Mac needs its own license. To move your license to a new Mac, enter your license key in the App on the new Mac and choose “Move to This Mac”. The App then stops working on the other Mac within a few hours of use if it is online, or once it next connects to the internet. You can move a license up to 3 times in any 30 days; beyond that, email support@notchy.dev from your purchase email or with your license key and we will help. This limit exists so that one license is not shared across several Macs, and we may decline moves that look like such sharing. Before you sell, give away or wipe a Mac, choose “Deactivate This Mac” in Settings › License to free the license.

6. Refunds

If Notchy isn’t right for you, you can ask for a full refund within 14 days of purchase, for any reason. Email support@notchy.dev from your purchase email (or include your order details). Refunds are issued by Dodo Payments to your original payment method and usually arrive within 5 to 10 business days. A refunded license is deactivated. After 14 days, we consider refund requests case by case, for example if the App does not work as described on your Mac. The charge appears on your card statement as DODOPAY_NOTCHY. Please contact us before opening a chargeback or payment dispute so we can resolve it directly; a license may be deactivated while a dispute is open, and is restored if the dispute is resolved in your favor.

This refund promise is in addition to, and does not limit, any right of withdrawal, refund or remedy that the law where you live gives you.

7. Supporter Licenses

People who supported Notchy through Ko-fi or Buy Me a Coffee before the paid release receive a free lifetime license by email. It is the same license as a purchased one, under these Terms, and is not refundable because no payment was made for it. If yours hasn’t arrived, email us from the address you supported with.

8. License Termination

We may deactivate a license that was refunded, charged back, obtained by fraud, or shared in breach of section 5. We do not otherwise end a valid license. Uninstalling the App does not end your license; you can reinstall and keep using it on the same Mac.

9. Use Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the App, except where applicable law permits it, including for interoperability.
• Modify, adapt, or create derivative works based on the App.
• Redistribute, sell, lease, or sublicense the App without explicit permission.
• Use the App in any manner that violates any applicable local, national, or international law.

10. Intellectual Property

The App, the Website, and all related intellectual property rights (including but not limited to source code, UI/UX design, branding, and assets) are the exclusive property of Notchy and its creators. Your use of the App does not grant you any ownership rights.

11. Disclaimer of Warranties

To the extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE" without additional contractual warranties. We do not guarantee that the App will be free of bugs, errors, or interruptions. Statutory warranties and consumer guarantees that cannot be excluded remain in force.

12. Limitation of Liability

To the extent permitted by applicable law, Notchy, its creators, or affiliates exclude liability for indirect, incidental, special or consequential loss arising from use of the App or Website. This does not exclude liability for fraud, willful misconduct, death or personal injury caused by negligence, or any liability or remedy that cannot lawfully be excluded or limited.

13. Changes to Terms

We may update these terms and will identify the revision date above. Material changes will be brought to users’ attention through the Website or App as appropriate. A change does not retroactively remove accrued rights. Where required by applicable law, we will seek your express acceptance before a material change applies.

14. Privacy and Local Rights

Our privacy policy explains personal information and website privacy controls. These terms do not impose a mandatory arbitration clause, waive class-action rights, or deprive you of mandatory protections or access to courts available under the law that applies to you.
